If a decedent had a properly drafted and funded trust, probate is generally not required. While a Will is a public document, a trust is a private document and need not be filed with the probate court. However, the successor trustee must still take the necessary steps to administer the trust.

Trust administration involves:

* Contacting beneficiaries and heirs of the trust;

* Identifying, gathering and valuing the trust-maker's assets;

* Paying any debts and expenses;

* Notifying potential creditors;

* Filing and paying taxes;

* Distributing assets and/or income to beneficiaries according to trust provisions

* Advice as to disposition of jointly held assets, life insurance, and retirement benefits that pass outside a will or trust

A trust can be administered within weeks, whereas probate can take 9-18 months, sometimes longer.
