Have You Made This Estate Planning Mistake?

Nicole K. White, Esq.

Have you ever thought about writing your own will? Maybe you thought about using one of those fill-in-the-blank forms advertised on TV? Estate planning is too complicated a process to do it yourself or to use a fill-in-the-blank form. There are too many areas where things can go wrong:

  • Drafting the Will so it is in compliance with your state's laws;
  • Drafting the Will to avoid or eliminate estate taxes;
  • Executing the Will so it will be valid in your state;
  • Disinheriting beneficiaries; and
  • Naming a personal representative or trustee.

A mistake, no matter how small, in any one of these areas may ultimately hurt your family.  Also, keep in mind that when you do it yourself or use the fill-in-the-blank forms, you are drafting a Will in the dark with no legal guidance or counseling, which can lead to unintended results.

Only an experienced estate planning attorney will be able to walk you through the estate planning process and then draft a plan that is customized for you and your family. Generic, fill-in-the-blank computer programs or forms cannot do this.
